Privacy Policy

Version 2.1 · Last updated: November 5, 2026

This Privacy Policy explains how MyA Memorials collects, uses, shares, keeps and protects personal information when you visit myamemorials.com, create an account, upload photos, request a service or place an order (together, the "Services"). We know the photos and words you share with us often honor someone you have lost, and we treat them with care and discretion.

1. Who we are

MyA Memorials is a trade name of MyAVest LLC, a Florida limited liability company ("MyA Memorials", "we", "us" or "our"). MyAVest LLC is the business responsible for (the "controller" of) the personal information described in this policy.

Privacy questions and requests: support@myamemorials.com. Mailing address: 18538 NW 19th Street, Pembroke Pines, FL 33029.

2. Information we collect

We collect only what we need to design, produce and deliver your memorial and to run a safe store:

  • Contact and order information: your name, email address, phone number, billing and shipping addresses, the products you choose, the options and prices of your order, and your messages with us.
  • Photos, memorial text and design data: the images you upload (which usually show a loved one who has passed away, and may show other people), the names, dates, epitaphs and other text you write, and your design settings (shape, size, template, crop, colors and fonts). We also keep the proofs our designers prepare and your approval of them or the changes you request.
  • Account information (optional): if you create an account, your name, email, phone, saved addresses, a secure hash of your password (never the password itself), your order history and the devices where you are signed in.
  • Payment information: payments are processed by Stripe. Your card number is entered on Stripe's systems and never reaches our servers; we receive only the payment confirmation, the amount and any refund details (Stripe may show us the card brand and last four digits).
  • Shipping information: the address, package details and tracking numbers we exchange with our shipping-label provider and carriers.
  • Service requests: when you ask for a photo restoration or a quote, the details and photos you send us.
  • Technical and usage information: your IP address, browser and device type, the pages you request, the date and time, error reports and performance data, collected automatically by our servers and by Microsoft Azure Application Insights. We use it to keep the Services secure, prevent fraud and abuse, and fix problems.
  • Browser storage and cookies: see section 9.

We do not use facial recognition and we do not create biometric identifiers from your photos. When a photo is uploaded we remove its location and camera data (EXIF/GPS). We do not ask for, and ask you not to send, Social Security numbers, health information or other sensitive personal information.

3. How we use your information

  • To fulfill your order: to build your design and price it, accept payment, prepare proofs, produce, pack and ship your product, and handle remakes, returns and refunds.
  • To communicate with you: order confirmations, proofs, status updates, shipping and tracking notices, password resets and replies to your messages.
  • To run your account, if you choose to have one: to fill in your details and show your order history.
  • To keep the Services safe: to authenticate users, prevent fraud, spam and abuse, enforce our Terms and protect our customers, staff and partners.
  • To operate and improve the Services: to diagnose errors, measure performance and improve our products and website.
  • To comply with the law: accounting, tax, and responses to valid legal requests.
  • To show a design as a sample, only if you checked the optional permission box for that item (see section 9 of the Terms of Sale). You can withdraw that permission at any time and we will remove it.

We rely on these purposes because they are necessary to provide what you asked for, to meet our legal obligations, for our legitimate interest in running a secure business, or, for gallery samples, on your consent. We do not use your photos or memorial text to train artificial intelligence models, and we do not use your information for targeted advertising.

4. How we share your information

We do not sell your personal information and we do not share it for cross-context behavioral advertising. We disclose it only as needed to provide the Services, and each recipient receives only what its role requires:

  • Our production laboratory, which prints and finishes porcelain and other products: it receives your design and print files, the product details and, to ship your order, your name, phone number and shipping address. It does not receive your email address or what you paid.
  • Our designers, when you request designer review or photo restoration: they receive your photos, memorial text, design and requested changes. They do not receive your email, phone, address or payment information.
  • Stripe (payment processing and fraud prevention).
  • Shippo and the shipping carriers (such as USPS, UPS or FedEx) that create labels and deliver your package.
  • Microsoft Azure, which hosts our website, database, files and backups, and provides Application Insights monitoring.
  • Our email delivery provider, which sends our transactional emails.
  • Google Fonts: our pages load fonts from Google, which receives your IP address and browser information when the fonts are downloaded.
  • Authorities and others when required by law, such as in response to a subpoena or court order, or to protect the rights, property or safety of our customers, the public or us.
  • A successor business, if MyAVest LLC is involved in a merger, acquisition or sale of assets, under a commitment to honor this policy.

Our service providers may use your information only to provide their services to us and must protect it; some (such as Stripe) also process it under their own privacy policies as independent businesses.

5. Your photos and memorial content

Photos and memorial text are used only to create, review and produce your order (or your service request). Access is limited to the staff, designers and laboratory that need them for that order. Privacy laws generally protect information about living people, but we give photos and details of the deceased the same confidentiality as yours. Please upload only photos and text you have the right to use (see the Terms of Sale).

6. How long we keep information

  • Photos, print files and proofs: up to 24 months after their most recent use, so we can remake or reorder your memorial; then they are deleted. Designs you allowed us to publish as samples are kept while they remain published. You may ask us to delete them sooner.
  • Order and payment records: for as long as needed for accounting, tax and legal purposes (generally up to seven years), even if you delete your account; they are then no longer linked to any account.
  • Accounts: until you delete your account from My account or ask us to. "Remember me" keeps a device signed in for up to 60 days.
  • Emails we send: the content of each email is erased from our systems once it has been sent (or within 7 days if it could not be delivered), and the delivery record is removed after 30 days.
  • Technical logs and monitoring data: for a limited period, generally up to 90 days, unless needed longer to investigate a security incident.
  • Deleted files and backups: for protection against accidental loss, deleted files remain in secure backup storage for up to 14 additional days and are then permanently erased. Database backups, which may contain order records, are kept for up to 12 months for accounting and disaster-recovery purposes and are overwritten on a rolling schedule.

7. How we protect information

We use encrypted connections (HTTPS/TLS), encryption at rest in our cloud storage and database, role-based access so that each person on our team sees only what their role requires, hashed passwords, rate limits, secure proof links, activity logs and regular backups. No system is perfectly secure; if a breach affects your personal information, we will notify you and the authorities as required by law, including the Florida Information Protection Act (Fla. Stat. § 501.171).

8. Your rights and choices

Wherever you live, you can ask us to:

  • Access the personal information we hold about you and receive a copy in a portable format;
  • Correct inaccurate information;
  • Delete your information, subject to the records we must keep by law (section 6);
  • Withdraw consent to show a design as a sample.

You can update most account details and delete your account yourself from My account. For anything else, write to support@myamemorials.com. We will verify your request by confirming control of the email address on the order or account, and we respond within 45 days (we will tell you if we need up to 45 more). You may use an authorized agent with your signed permission. If we decline a request you may appeal by replying to our decision, and we will answer within 60 days. We will never discriminate against you for exercising your rights.

California residents (California Consumer Privacy Act, as amended by the CPRA, Cal. Civ. Code § 1798.100 et seq.): in the last 12 months we collected the categories of information described in section 2 (identifiers, customer records, commercial information, internet or other electronic activity, approximate location derived from IP address, and the photos and text you provide), from you, your device and our service providers, for the business purposes in section 3, and disclosed them to the categories of recipients in section 4. We have not sold or "shared" personal information, we do not use or disclose sensitive personal information to infer characteristics, and we have no actual knowledge of selling or sharing information of consumers under 16. We treat a Global Privacy Control signal as an opt-out request. Under California's "Shine the Light" law (Cal. Civ. Code § 1798.83) we do not disclose personal information to third parties for their direct marketing purposes.

Florida residents: the Florida Digital Bill of Rights (Fla. Stat. §§ 501.701–501.722) applies to businesses that meet thresholds MyA Memorials does not meet, but we offer the same access, correction, deletion and portability rights described above to every customer. Residents of other states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut and Texas) can exercise their rights the same way.

Do Not Track: because we do not track you across other websites, our Services work the same whether or not your browser sends a Do Not Track signal.

9. Cookies and browser storage

We do not use advertising or third-party tracking cookies. To make the site work, we store a few items in your browser's local or session storage: your cart, the contact details you typed at checkout, your language and display preferences, a notice you dismissed, and, if you sign in, your session. You can clear them at any time in your browser settings; the store will then forget your cart and sign you out. Our monitoring service may use technical identifiers to group the requests of a single visit for performance and error reporting.

10. Emails

We send transactional and relationship emails about your orders, proofs, account and requests; these are part of the service and cannot be turned off while an order is active. We do not currently send marketing emails. If we do in the future, we will only send them in accordance with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.): each will identify us, include our postal address and a working unsubscribe link, and we will honor unsubscribe requests within 10 business days.

11. Children

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501–6506). If you believe a child has given us personal information, contact us and we will delete it. Photos of minors that a parent or guardian includes in a memorial design are used only to create that order.

12. Where your information is processed

MyA Memorials serves customers in the United States, and our website, database and files are hosted in data centers in the United States. Some of our service providers, or members of our design team, may process information in other countries; when that happens, we require them to protect it consistently with this policy. If you use the Services from outside the United States, your information will be transferred to and processed in the United States.

13. Changes to this policy

We may update this policy as our Services or the law change. The version number and date at the top of this page show when it last changed. If we make material changes, we will post the new version here and, where appropriate, notify customers with active orders or accounts by email before the change takes effect.
