Terms of Sale

These Terms of Sale govern purchases made on this website from MyA Memorials, a trade name of MyAVest LLC, a Florida limited liability company ("we", "us"). By checking "I have read and agree" at checkout and placing an order, you agree to these terms and to our Shipping, Returns & Remakes, Image Quality, Cemetery & Installation and Privacy policies, in the versions published on the day of your order.

1. Personalized products

All memorial photos, plaques, acrylic prints, photo enlargements and keepsakes are custom made to order using the images and text you provide. Because each product is unique, orders cannot be cancelled once production has started and cannot be returned for change of mind.

We offer three materials: Porcelain, Acrylic and Enlargements (photo prints). Porcelain plates are cut only in square or rectangle shapes. Designs such as heart, oval or circle are printed on the plate as part of the image; the plate itself is not cut in that shape.

2. Your content

• You confirm that you own, or have permission to use, every photo and text you upload, and that it does not infringe anyone's rights.
• You are responsible for reviewing spelling, names, dates, cropping and the preview before ordering. We produce what you approve.
• We may refuse or cancel (with a full refund) any order containing offensive, unlawful or infringing content.

3. Previews and color

The online preview is a close representation of the final product. Printed porcelain and acrylic can show small variations in color, contrast and position compared with a computer or phone screen. Such variations are not defects.

4. Prices and payment

Prices are in U.S. dollars. Shipping is calculated at checkout. Prices do not include taxes; if the law requires us to collect sales tax on your order, it will be shown at checkout before you pay. Payments are processed securely by Stripe; we do not see or store your full card number. Your order is confirmed when payment is approved.

5. Production times

Production starts once payment is received and, when designer review is requested, once you approve the proof. Delivery dates depend on the carrier and are not guaranteed.

6. Designer services

Designer review and photo restoration are best-effort artistic services. Results depend on the original image. If a restoration cannot reach an acceptable result, we will tell you before production and offer alternatives or a refund of the service fee.

7. Cancellations

You may cancel for a full refund before your order enters production by contacting support@myamemorials.com. After production starts, orders cannot be cancelled.

8. How your order is produced

We sell the products on this website and coordinate their production. Printing, manufacturing and shipping are performed by independent production partners (laboratories) and by carriers, who are not our employees or agents.

9. Your approval

Your approval of the online preview, or of the proof sent by our designer, is final. We are not responsible for errors in names, dates, spelling, text, photos or cropping that appear in the preview or proof you approved.

10. Warranties

Except for the remake or refund described in our Returns & Remakes policy, products and services are provided "as is". To the extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

11. Limitation of liability

To the extent permitted by law, our total liability for any order is limited to the amount you paid for it. We are not responsible for installation performed by third parties, for cemetery regulations or for damage caused by vandalism, impact, improper installation or natural disasters, except as provided in our Returns & Remakes policy.

To the extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, including emotional distress, loss of use or lost profits, arising from a product or its production, delivery or installation, even if we were told such damages were possible.

12. Responsibility for your content

You agree to defend and hold harmless MyAVest LLC, its owners and its production partners from claims by third parties arising from the photos, text or other content you upload, including claims that you did not have the right to use them.

13. Optional permission to show your design

When designing an item you may check an optional box authorizing us to show your design. Checking it is never required to buy and does not change the price. If you check it, you grant MyA Memorials a non-exclusive, royalty-free, worldwide license to reproduce and display the design preview and photos of the finished piece as samples on our websites, social media and printed marketing materials, without further compensation.

• You confirm that you own the photos and text of the design or have the permission of the people who do, including the family of the person portrayed.
• We may crop the image, hide or blur names, dates and other personal details, and we never publish your contact information.
• You may withdraw this permission at any time by writing to support@myamemorials.com. We will remove the design from our website within 10 business days; printed materials already produced may remain in circulation.

14. Disputes

Please contact us first: most problems are solved quickly. If a dispute is not resolved within 30 days, it will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and we waive the right to a jury trial and to take part in a class action. These terms are governed by the laws of the State of Florida.

15. Changes and record of acceptance

We may update these terms and our policies. Each policy shows its version number and date. The versions in effect when you place an order apply to that order. When you check "I have read and agree", we save with your order the date and time and the version of each policy you accepted.
